TERMS & CONDITIONS

This "Chipsmore x Monopoly" Activation (hereinafter referred to as "Contest”) is conducted by Mondelez Singapore Sales Pte Ltd having its business office at at 346 Jln Boon Lay, Singapore 619528 (hereinafter referred to as "Organizer").

Your participation in this Contest is subject to your acceptance of the terms and conditions contained under Part 1 and Part 2 herein (together "T&Cs"). Please read and understand the T&Cs before participating in the Contest.

For the purposes of Part 1 T&C, wherever the context so requires ("Contestant") or ("Winners”) where applicable shall mean any natural person who is qualified to participate in the Contest.

ELIGIBILITY

• Contestants need to fulfill the following eligibility criteria to participate in the Contest:
• Contestants should be an individual legal resident and citizen, or a permanent resident of Singapore aged 18 years old or above as stated on their NRIC/Passport at the time of entry into the Contest.
• Contestants shall be legally competent to enter a binding contract under the applicable laws of Singapore.
• The Contest is subject to all applicable local laws and regulations of Singapore.
• The Contest may at any time, at the sole discretion of Organizer be terminated/ canceled /amended/suspended for any reasons whatsoever without providing any prior notice to the Contestants. No claims/questions shall be entertained in this regard.
• The following group of persons shall not be eligible to participate in the Contest:
  1. Employees of the Organizer (including its affiliated and related companies) and their immediate family members (children, parents, brothers and sisters, including spouses); and
  2. Representatives, employees, servants and/or agents of Hasbro Singapore Pte. Ltd, agencies and/or contest service providers providers of the Organizer (including its affiliated and related companies), and their immediate family members (children, parents, brothers and sisters, including spouses).
• Organizer reserves the right to exclude or disqualify any person from the Contest on grounds of: (a) misconduct or criminal record or acted or have the intention to act in a dishonest or fraudulent manner or in bad faith; (b) tampering with the entry process or the operation of the Contest; (c) acting in violation of these T&Cs; (d) acting in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person; (e) entries being offensive, distasteful, unacceptable or which may be considered disparaging; or (f) for any other reasons, as the Organizer may deem fit and proper.

PART 1: SUBMISSION AND QUALIFYING CRITERIA OF CONTEST

• To participate in the Contest, Contestant needs to purchase any Chipsmore product(s) worth SGD2.00 in a single receipt from any participating outlets throughout the Contest Period. Contestants must ensure to register correctly on the microsite and select ‘Singapore’ as their home country should the contestant resides in Singapore.
• The proof of purchase (“POP”) required is one (1) original printed receipt of purchase of any Chipsmore product within the Contest Period. Contestants must retain the original receipts submitted throughout the Contest Period for verification and redemption of Prizes. Failure to present the original receipt will result in forfeiture of the Prizes.
• Submission of entries for the Contest will be via the More Chips, More NFTs Microsite www.chipmoremonopoly.com
• Contestants are required to include:
  1. their full name as per their NRIC/Passport; and
  2. proof of purchase (receipt)
• Contestants will also get one (1) free BONUS DICE ROLL should the Contestant purchase any Chipsmore Oats product within the same receipt.
• A valid receipt must have the following criteria:
  1. Store name and / or logo printed on the receipt
  2. Printed receipt date is within the stated Contest Period (1 Sept – 30 Oct 2022)
  3. Chipsmore products purchased, and purchase value stated clearly.
  4. Clear photo of full original receipt. Photocopies are not accepted.
  5. Receipts are printed officially from participating stores. No hand-written receipts are accepted.
  6. Invoice number
• Total purchase value of Chipsmore products after promotion price must equal to or above the SGD2.00 value in order to participate
• Proof of submission of an entry is not proof of receipt. Organizer shall not be liable for any delay, lost, damaged and/or non-receipt of submissions, any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, or any problems or technical malfunction of our telecommunications network or lines, computer online systems, servers or providers, computer equipment, software, failure of e-mail or players on account of technical problems or traffic congestion on the Internet.

PRIZES

• All Winners will be notified via email and /or WhatsApp text by the agency appointed by the Organizer (hereinafter referred to as “Agency”).
• Winners shall comply with the Agency's request for contact details within thirty (30) working days in order to receive both physical and NFT prizes, if applicable, which involves creation of Metamask Wallet. Failure to do so will result in disqualification and the Agency has the right to select the following Contestant from the chipsmoremonopoly.com Contest leaderboard comprising Contestants from the Malaysia and Singapore Contests (“Leaderboard”) ranking for prize allocation.
• Physical Prizes will be delivered to the Winners within 45 working days of notification or such other period as may be determined solely by the Organizer.
• Pictures of Physical Prizes shown in any advertisement, promotional, publicity and other materials relating to or in connection with this Contest are solely for illustration purposes only and may not depict the actual colour, model or specification of the Prizes and does not include any optional accessories. The names and logos of the Prizes are trademarks of the respective owners.
• Physical prizes (only) are given out on an “as is where is” basis and are non-transferable, non-refundable, non-exchangeable for cash or with vouchers of other denominations, whether in part or in full. Organizer shall reserve the right at its absolute discretion to substitute the prize with that of similar value, at any time without prior notice.

WINNER SELECTION

• Grand Prize Winners x (3)
  

  Winners will be selected and determined based on the top 3 Contestants who manage to stay on the 1st, 2nd and 3rd position of the Leaderboard by the end of the Contest Period.

• Second Tier Prize Winners x (25)
  Winners will be determined based on the ranks from Four (4) to Twenty-Eight (28) in the Leaderboard by the end of the Contest Period.
• Third Tier Prize Winners x (72)
  Winners will be determined based on the ranks from Twenty-Nine (29) to One Hundred (100) in the Leaderboard by the end of the Contest Period.
• Consolation Prize Winners
  The Winners will be determined by the first 1,195 number of contestants who scored minimal 350 points and did not win top One (1) to One Hundred (100) prizes. Prizes will be assigned at random basis.

LIABILITY AND INDEMNITY

• The Organizer shall not be liable for any incomplete, lost, late, damaged, illegible or misdirected entries for any reason whatsoever or problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the internet or at any website, or any combination thereof (including but not limited to) any injury or damage to the Contestants or their personal computer or telecommunication device related to or resulting from participation in the Contest and it’s mechanics.
• To the extent permitted by law, each Contestant and any person acting on his/her behalf agree that the Organizer shall not be responsible and / or liable for any loss, injury, death, claim or damage suffered by any person arising out of or in connection with the Contest and / or use of the Prizes (both physical and NFT), and shall completely release and indemnify the Organizer and its officers, agents and employees (hereinafter referred to as "the Indemnified Parties") from any or all claims losses, damages, costs or expenses incurred in connection therewith.
• By participating in the Contest,
  
  1. the Contestants shall indemnify and keep the Indemnified Parties fully indemnified against any and all loss, damage, claims and costs (including legal costs on a full indemnity basis) suffered and/or incurred by any of the Indemnified Parties as a result of the Contestants’ breach of any of the T&Cs herein contained.
  2. The Organizer assumes no responsibility or liability for the acts or defaults of merchants or third parties, any non-delivery, non-performance or defects in any prize given out in the course of the Contest. The Organizer makes no representation or warranty whatsoever in respect of any Prize, whether as to the satisfactory quality or performance or otherwise whatsoever. For the avoidance of doubt, The Organizer is not an agent of any merchant or vice versa. Any dispute should be resolved directly with the relevant merchant.
  3. The Contestants agree to indemnify the Organizer, Agency and/or GuardianLink Blockchain Labs Pte.Ltd, (“Service Provider”) (where the context may so require) and any of its/ their respective officers/employees from and against all liability, cost, loss or expense arising out of acceptance of the Prize (both physical and NFT) and/or participation in the Contest including (but not limited to) personal injury and damage to property and whether direct, indirect, consequential, foreseeable, due to some negligent act or omission, or otherwise.
  4. The Contestants agree to bear responsibility for any or all taxes resulting from receipt of the Prize and/or participation in the Contest.

Use of Personal Information/ Intellectual

Contestants’ participation in the Contest is conditional upon the Contestants consenting to the Organizer and its affiliated companies and business units using the Contestants’ personal data for the following purposes which are in accordance with the Personal Data Protection Act 2012 of Singapore:

• to notify the Contestants if they have won the Prizes;
• to conduct, manage, and administer the Promotion including verifying the identity of Contestants for participation or prize collection;
• for consumer research, analysis, promotional, advertising and marketing purposes; and
• for the Organizer and its affiliates to obtain feedback on its products and services.

The Organizer and its affiliated companies and business units may share a Contestant’s personal data between themselves for administrative purposes, and with third parties supporting their administrative and business functions. In some cases, this may involve the storage, use, disclosure or other processing, or transfer of Contestant’s personal data out of Singapore. The Organizer and its affiliated companies and business units may also share a Contestant’s personal data with third parties to carry out cross- promotion. By participating in the Promotion, the Contestants consent to the use of their personal data for the purposes listed above.

Each Contestant also agrees that all worldwide intellectual property rights in any statement, materials or content submitted, made or created by a Contestant in connection with the Contest and any derivative works arising therefrom will be perpetually and unconditionally vested in, assigned to, and owned by the Organizer or its affiliated companies. The Organizer has the right to use and modify such materials and / works in any way it deems fit without the need to provide any compensation to any Contestant and each Contestant unconditionally and irrevocably waives all rights (including moral rights) he or she may have in such materials or works. The Contestant hereby expressly waives any and all rights which the Contestant may acquire or have and any other moral rights which the Contestant may have or be entitled under any such legislation now existing or in the future enacted in any part of the world.

Any information, personal data and material about or obtained from the Contestants may be accessed, stored or otherwise processed in any medium or format determined by the Organizer.

Any trademarks, graphic symbols, logos or intellectual property contained in any materials used in connection with the Contest, in particular that relating to the Contest prizes, are the property of their respective owners. The Contest and the Organizer are not affiliated with, or endorsed or sponsored by, the relevant owners, where such owners are independent and not part of the Organizer group of companies.

PART 2: GRAND PRIZE & SECOND TIER PRIZE WINNER’S TERMS AND CONDITIONS:

• REDEEMING NFTS OFFICIAL RULES

  By entering the Contest, Contestants acknowledge that the Organizer bears no responsibility for the NFT prizes once it has been transferred to the Winners, and the Winners unconditionally and irrevocably release the Organizer, Agency and Service Provider from any or all liability whatsoever in connection with this Contest, NFT prizes and future NFT transactions. For the avoidance of doubt, the Organizer, Agency and Service Provider are not responsible for sale of the NFT prizes by the Winners.

  Winners understand that they are providing information to the Service Provider for the NFT Prizes redemption and transfer. Any questions, comments or complaints regarding the NFT prizes must be directed to the Service Provider and not to the Organizer.

  In addition to the terms and conditions stipulated in the T&Cs herein contained, the Winners shall also be bound by the privacy policy of the Service Provider as the data would be processed and utilised by Service Provider towards delivery of the NFT prizes. The privacy policy can be found on the Service Provider’s website (https://www.guardianlink.io/).

• ADDITIONAL TERMS OF NFT PRIZES

  NFTs, or non-fungible tokens, are intangible digital assets that exist only by virtue of the ownership record maintained in the applicable blockchain network. For the Contest, the OpenSea network is being used (“OpenSea”) by Service Provider. Please read below for additional information about the NFT Prizes awarded by the Organizer through this Contest, including terms and conditions for use of the NFT Prizes.

  By accepting the NFT Prize, Winners hereby agree to the T&Cs herein contained, which are incorporated into, and made a part of, the Contest T&Cs.

• REDEEMING THE NFT

  Winners of NFT prize will redeem through the Service Provider to accept NFT Prize, Winners will be required to open a Metamask account (electronic wallet) that is compatible with OpenSea platform (a “Wallet”). This wallet ID will then have to be shared with Service Provider to facilitate the redemption. Winners’ use of Metamask as Winners’ Wallet shall be governed by the applicable terms and conditions of OpenSea.io and agree to provide data information necessary for the Service Provider to facilitate the redemption as per their privacy policy (https://www.guardianlink.io/).

  Transactions that take place through the Service Provider with Metamask are solely to transfer the NFT prizes to the Winners. Winners understand that OpenSea account will be made publicly visible whenever Winners engage in a transaction on the OpenSea platform.

  Winners agree that the Organizer and/or the Service Provider have no control over transactions on Metamask and OpenSea, nor does the Organizer and/or the Service Provider have the ability to reverse or refund any payments or transactions relating to the NFT prizes. Winners agree that the Organizer and/or Service Provider shall not be liable to Winners or any third party for any claims or damages that may arise as a result of Winners engaging in transactions via Metamask or otherwise via OpenSea, including taxes that occur post the transfer of NFT to the Winners.

  By participating in this Contest, Winners agree not to take any action on the Organizer and/or the Service Provider that involves or results in the wrongful seizure or receipt of any NFTs, including the purchase or sale of NFT prizes by illegal means.

IMPORTANT

If you are dissatisfied with the Contest or any aspect of the Contest, including the T&Cs, your sole and exclusive remedy is to not participate in the Contest.

A Winner may choose not to accept the NFT as a prize, but he/she shall not be given another prize in lieu of the NFT prize and / or any other form of compensation for any reason whatsoever. The Organizer shall reserve the right to deal with the foregoing NFT as it deems fit.

Should Winners choose not to accept the NFTs, they are to inform the Service Provider in writing of their decision when approached for their details.

OWNERSHIP OF THE DIGITAL COLLECTIBLE AND ASSOCIATED NFT

When a Winner has been awarded an NFT prize, the Winner becomes the owner of the NFT. The Organizer grants full ownership to the Winner but shall retain all intellectual property rights, title, and interest in and to the Artwork once the NFT prizes are transferred to Winner.

The Organizer hereby grants to each Contest winner who is awarded an NFT Prize a worldwide, non-exclusive, perpetual, royalty-free license to use, and display the NFTs in connection with the digital collectible and in accordance with the terms herein contained. If Winners choose to transfer the NFT Prize, such license shall automatically be deemed assigned to the subsequent transferee. A Winner’s right to transfer the NFT Prize to a transferee is conditioned upon (i) the transferee’s acceptance of (i) the T&Cs herein contained, including terms specific to the NFT Prizes and (ii) the terms and conditions of the applicable third-party platform used to make the Transfer.

Each Winner of the Contest agrees that he/she shall not authorize or permit any third party to, do or attempt to do any of the foregoing: (a) modify the artwork design in the NFT prize (”Artwork”) in any way, including, without limitation, the shapes, designs, drawings, attributes, or color schemes; (b) use the Artwork to advertise, market, or sell any product or service; (c) use the Artwork in connection with images, videos, or other forms of media that depict hatred, intolerance, violence, cruelty, or anything else that could reasonably be found to constitute hate speech or otherwise infringe upon the rights of others; (d) use the Artwork in any other forms of media, except to the limited extent that such use is solely for the winner’s own personal, non-commercial use; (e) sell, distribute for commercial gain (including, without limitation, giving away in the hopes of eventual commercial gain), or otherwise commercialize merchandise that includes, contains, or consists of the Artwork; (f) attempt to trademark, copyright, or otherwise acquire additional intellectual property rights in or to the Artwork; or (g) otherwise utilize the Artwork for the Winner’s or any third party’s commercial benefit.

ASSUMPTION OF RISKS RELATED TO NFTS AND BLOCKCHAIN

Any transfer of NFT prize by Winners, shall be entirely at the Winners’ risk. The Organizer and Service Provider do not control or endorse transfers of NFT prize. Neither the Organizer nor Service Provider shall be liable or responsible for any sale of the NFT prize by the Winners.
Winners accept and acknowledge that the Organizer and/or Service Provider shall not be responsible for any communication failures, disruptions, errors, distortions or delays. Winners may experience when using metamask and opensea, howsoever caused. Upgrades to the web3 wallet and Opensea, or a change in how transactions are confirmed on a web3 wallet may have unintended, adverse effects on Winners and NFT prizes, for which neither the Organizer nor Service Provider shall be held liable whatsoever. Neither the Organizer nor the Service Provider shall be responsible for losses due to any mishap relating to the blockchain or any other features of any third party marketplace(s), or any web3 wallet, including, but not limited to late reports by developers or representatives (or no report at all) of any issues with the blockchain supporting the third party marketplace(s), including forks, technical node issues, or any other issues resulting in fund losses.
The Organizer and the Service Provider shall not be responsible or liable to any Winner for any losses incurred as a result of Winners’ use of metamask, opensea or any other third party marketplace(s) , web3 wallets, including, but not limited to, any losses, damages or claims arising from: (i) user error, such as forgotten passwords or other such actions or omissions; (ii) server failure or data loss; or (iii) unauthorized access or activities by third parties, including, but not limited to, viruses, phishing, brute-forcing or other means of attack against metamask or any other web3 wallet service, the Opensea network or any other third party marketplace(s).
The Organizer and the Service Provider make no representation or warranties as to the value of the NFT Prize awarded in the Contest.

PERSONAL INFORMATION AND PRIVACY POLICY:

When Winners participate in the Contest, the Service Provider shall handle, transfer, process and mint the NFT prizes for the Winners and otherwise deal with personal information which is provided by the Winners. This information may vary but will typically include information like first and last name, mailing address, complete date of birth, e-mail address, contact number, identity verification documents and details therein, etc. By participating in the Contest, Winner’s consent to the collection, receiving, possession, use, storage, dealing, processing, sharing and handling of the information including personal information Winners disclosed to the Service Provider.
Please also visit the Privacy Notice of Service Provider available on the website (https://www.guardianlink.io/) to understand the nuances of data collection, sharing and processing by the Service Provider.
Winners acknowledge that the Organizer shall not be responsible for the collection and processing of personal data by the Service Provider under this Contest. The Service Provider shall solely be responsible to Winners for collection and processing of Winners personal data shared under the Contest.

FORCE MAJEURE:

This Contest is subject to force majeure circumstances including without limitation, floods, natural disasters, war, act of terror, political unrests, technical snags, lockdowns or related restrictions, act of God or any circumstance beyond the reasonable control of the Organizer and/or Agency and/or the Service Provider ("Force Majeure Event"). Neither the Organizer nor the Agency and Service Provider shall be liable for any delay or adverse effect caused to the Winners in the Contest as a result of a Force Majeure Event.
